NOTICE OF SEIZURE AND PROPOSED FORFEITURE
The United States Department of the Interior, U.S. Fish and Wildlife Service, Office of Law Enforcement is commencing a forfeiture proceeding
against the following wildlife or wildlife products (“property”), which were seized in Champlain,NY on the dates indicated below.
The property was imported in violation of the following laws and/or regulations of the United States:
16 USC 1538(c)(1);It is unlawful for any person subject to the jurisdiction of the United States to engage in any trade in any specimens contrary to the provisions of the Convention, or to possess any specimens traded contrary to the provisions of the Convention, including the definitions of terms in article I thereof. 50 CFR 23.13 (a): Import, export, re-export or trade in any Appendix I, II, III species in violation of Part 23.
16 USC 1538(d)(1)(A);Engage in Business of Importing or Exporting Wildlife or Plants Without a License 50 CFR 14.91(a): Except as otherwise provided in this subpart, it is unlawful for any person to engage in business as an importer or exporter of wildlife without first having obtained a valid import/export license from the Director.
16 USC 1538(e);Import/Export without Necessary Declarations or Reports (Failure to Declare or Submit Reports) 50 CFR 14.61: Failure to file wildlife import declaration as required
16 USC 1371(a); 50 CFR 18.12: Prohibited importation
16 USC 3372(b);Import, Export, Transport in Interstate Commerce without Appropriate Marking 50 CFR 14.81: Import, export or transport wildlife in a container not marked as required
16 USC 703;Impermissible Pursuit, Hunt, Take, Capture, Kill, or Attempt Take, Capture or Kill With Intent to Sell (or Offer), Barter (or Offer), Purchase (or Offer), Deliver, Ship, Export, Import (or caused to be) any Migratory Bird, Egg or Nest. . . 50 CFR 21.11: General permit requirements for any migratory birds (No person shall take, possess, import, export, transport, sell, purchase, barter or offer for sale, purchase or barter)
16 USC 1540(e)(4)(A); 50 CFR 14.52(c): To obtain clearance, the importer, exporter, or the importer's or exporter's agent will make available to a Service officer or a Customs officer acting under §14.54: (1) All shipping documents (including bills of lading, waybills and packing lists or invoices); (2) All permits, licenses or other documents required by the laws or regulations of the United States; (3) All permits or other documents required by the laws or regulations of any foreign country; (4) The wildlife being imported or exported; and (5) Any documents and permits required by the country of export or re-export for the wildlife.
16 USC 1538(a)(1)(G);Violate any Regulation 50 CFR 17.31(a): Except as provided in subpart A of this part, or in a permit issued under this subpart, all of the provisions in §17.21 shall apply to threatened wildlife, except §17.21(c)(5).
